Can I add fill to a flood plain?
Fill cannot be added to a FEMA determined floodplain. Please keep in mind that FEMA maps are simply indications of where FEMA thinks a floodplain might be located. The FEMA floodplains must still be delineated. The applicant must have an engineering analysis to determine what the flood elevation is on their property. No fill is allowed below that elevation. In some cases, fill may be allowed to be added to the floodplain provided it is removed in an equal volume elsewhere in the floodplain. Also, per Sec. 6-62(4), TLDC, there could be an exception if it is supported by computer modeling.
